Este viernes 20 de julio se dio a conocer el fallo de la Sala Penal Permanente de la Corte Suprema resolviendo disminuir la pena de 25 a 20 años de prisión para los máximos responsables del Grupo Colina, un escuadrón de la muerte implicado en violaciones contra los derechos humanos. Además se eliminó el delito de lesa humanidad a estos acusados.
On Friday, July 20, 2012, the Peruvian Supreme Court announced its decision to shorten from 25 to 20 years the imprisonment sentence for top members of the Colina Group, a death squad involved in human rights violations. They were also acquitted of having committed crimes against humanity.
Aunque Javier Villa Stein, el presidente de la Sala Penal de la Corte Suprema, fundamentó la decisión del retiro del delito de lesa humanidad en el hecho que los acusados “no perpertraron sus crímenes en el marco de un ataque generalizado como lo establece el Estatuto de Roma vigente para el Perú desde el 2003”, esta resolución generó de inmediato una serie de reacciones, en su mayoria contrarias a la misma.
Javier Villa Stein, president of the Criminal Chamber of the Supreme Court, stated that the decision to remove the verdict of crimes against humanity was based on the fact that the accused “did not perpetrate their crimes in the form of a widespread attack as established in the Statute of Rome, in force in Peru since 2003″. However, this was immediately met by a series of reactions, mainly against the decision.
Por ejemplo, Avelino Guillén, ex fiscal del caso Fujimori, declaró su indignación por el fallo, mientras que el Ministro de Justicia llamó a la decisión “una verguenza”. La abogada Gloria Cano de Aprodeh, una asociación pro DDHH, dijo estar inconforme y contrariada por la sentencia. Y Gisela Ortiz, representante de los deudos de las víctimas del operativo de La Cantuta, expresó que esto era una ofensa a la memoria de las víctimas.
For example, Avelino Guillén, former prosecutor in the case against former President Alberto Fujimori, declared his outrage for the ruling, whilst the Justice Minister called the decision “a shame”. The lawyer Gloria Cano of Aprodeh, a pro-human rights charity, declared she was unhappy and disgruntled at the ruling. And Gisela Ortiz, representative of the victims of the La Cantuta operation stated that the ruling was an insult to the victims' memory.
Por su parte el Presidente Ollanta Humala, rechazó la decisión y aseguró que ésta será apelada. Y es que ha surgido preocupación por el antecedente que esto significaría en los procesos seguidos al expresidente Alberto Fujimori, quien purga condena precisamente por crímenes de lesa humanidad, pues según Carlos Rivera, abogado del IDL (Instituto de Defensa Legal) la resolución “abre un camino político para otorgar cualquier tipo de beneficio.”
President Ollanta Humala rejected the decision and assured citizens that it would be appealed. The Supreme Court's decision has caused concern over the precedent it could set for the proceedings of former President Alberto Fujimori, who is serving a sentence precisely for crimes against humanity. According to Carlos Rivera, lawyer for the Institute of Legal Defence (IDL), the ruling “opens a political path to provide any sorts of benefits”.

El mensaje de Villa Stein es más claro que el agua. Puedes asesinar a cualesquier ciudadano peruano y te reducirán las penas siempre que lo hayas hecho a favor del estado reaccionario, caduco, pervertido y degenerado, haciendo ver a los actos de “justicia” como simples leguleyadas similares a los relacionados a robos comunes y corrientes.
Villa Stein's message is clearer than water. You can kill any Peruvian citizen and they will reduce your sentence if you did it to help the reactionary, decrepit, perverted and degenerate state, making these acts of “justice” look as simple as crimes such as ordinary and common theft.
En Facebook ya han surgido eventos contra la decisión judicial. Vigilia - No a la impunidad - Grupo Colina nunca más!!!, organizado por Movimiento Perú Diverso y otros, es uno de ellos.Esta vigilia se realizará el sábado 21 de julio desde las 6pm en la Plaza Francia del centro de Lima. Otro evento es Plantón contra libertad de los Colinas, organizado por Basta De Impunidad Cci, este evento se realizará el día lunes 23 a las 6.30pm frente al Palacio de Justicia.
There are already Facebook events against the ruling. “Vigil - No to impunity - Colina Group no more!!!” , organised by Movimiento Peru Diverso and others, is one of them. This vigil was scheduled to take place on Saturday, July 21 from 6pm in the centre of Lima (Plaza Francia). Another event is “Sit-in against freedom of the Colina members”, organised by Basta De Impunidad Cci, this event will take place on Monday, July 23 at 6.30pm in front of the Palace of Justice.
